Please read these terms carefully before using EDmazing Learning's website, assessment activities, or tutoring services.

1. Acceptance of Terms
By accessing or using EDmazing Learning's website (edmazinglearning.com), assessment activities, tutoring services, or any other services we offer (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you are using the Services on behalf of a school, school district, or other organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Services.
2. Description of Services
EDmazing Learning provides the following services:
- Interactive Assessment Activities: Self-contained, standards-aligned reading comprehension and math assessment activities for K–12 students, delivered as HTML files that run in a web browser
- AI Learning Insights: Automatically generated personalized teacher recommendations based on student performance, embedded in PDF reports
- Google Drive Integration: Automatic saving of student PDF reports to the teacher's own Google Drive account
- Online Tutoring: One-on-one or small-group tutoring sessions conducted via Zoom, which may include the use of third-party platforms such as Canva
- Educational Resources: Supplementary content, tips, and materials available on our website
3. Eligibility & Account Registration
Our Services are designed for the following users:
- Teachers and school administrators — may create accounts and use all platform features
- Parents and guardians — may enroll students in tutoring services and communicate with us
- Students — may use assessment activities as directed by a teacher and participate in tutoring sessions with parent/guardian consent
Students under 18 may not create accounts on our website. Student participation in assessment activities and tutoring is authorized by the student's teacher, school, or parent/guardian.
4. Teacher Accounts
Account Creation
- Teachers register using a name, email address, and password
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You agree to notify us immediately at alisha@edmazinglearning.com if you suspect unauthorized access to your account
Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update your information as needed to keep it accurate.
One Account Per User
Each teacher account is for a single individual. Accounts may not be shared with or transferred to other individuals without our written permission.
5. Assessment Activities
How Activities Work
Assessment activities are self-contained HTML files that run entirely in the student's web browser. Students enter only their first name and respond to questions. Upon completion, a PDF report is generated in the browser and saved to the teacher's Google Drive.
Permitted Use
- Activities are licensed for use by the purchasing teacher, school, or district in their own classrooms or tutoring sessions
- Activities may be shared with students via links, learning management systems, or other methods as directed by the licensed teacher
- Activities may not be resold, redistributed, sublicensed, or shared with other teachers, schools, or districts outside of the purchasing license
Student Use
Students access activities as directed by their teacher. No student account is required. The teacher is responsible for ensuring that student use of activities is consistent with their school's policies and applicable law.
6. Online Tutoring Services
Session Delivery
Online tutoring sessions are conducted via Zoom. During sessions, learners may be directed to use third-party platforms such as Canva, Google Docs, or other educational tools via shared links.
Enrollment & Consent
- A parent or guardian must authorize enrollment for any student under 18
- Scheduling and communication are conducted with the parent or guardian, not directly with the child
- Parents are encouraged to supervise young learners during online sessions
Session Conduct
- Students are expected to participate respectfully and follow the tutor's instructions
- EDmazing Learning reserves the right to end a session if a student's behavior is disruptive or inappropriate
- EDmazing Learning does not record video or audio of tutoring sessions
Cancellation & Rescheduling
- Sessions may be cancelled or rescheduled with at least 24 hours' notice by contacting us at alisha@edmazinglearning.com
- Sessions cancelled with less than 24 hours' notice may be forfeited at our discretion
- EDmazing Learning will make reasonable efforts to reschedule sessions disrupted by technical difficulties
No Guaranteed Outcomes
While we strive to provide high-quality, effective tutoring, EDmazing Learning does not guarantee specific academic outcomes, test scores, or grade improvements. Tutoring is a supplementary educational service.
7. Google Drive Integration
By connecting your Google Drive account, you authorize EDmazing Learning to:
- Save student PDF reports to your Google Drive on your behalf
- Use your OAuth token solely for the purpose of uploading report files
You understand that:
- Reports saved to your Drive are your responsibility — EDmazing Learning does not retain copies
- You may revoke access at any time via your Google Account permissions
- EDmazing Learning cannot access, read, modify, or delete any files in your Drive that were not created by our platform
- Google Drive usage is subject to Google's Terms of Service
8. AI-Generated Content
Every EDmazing Learning assessment generates an AI Learning Insight — a personalized analysis embedded in the student's PDF report. By using our assessment activities, you acknowledge and agree that:
- AI-generated insights are automated suggestions, not professional educational evaluations or diagnoses
- AI insights should be used as one input alongside the teacher's own professional judgment, not as the sole basis for educational decisions
- AI-generated content may occasionally contain errors, generalizations, or recommendations that may not be appropriate for every student
- EDmazing Learning is not liable for educational decisions made based on AI-generated insights
- Student data sent to the AI is processed in real-time, is not stored, and is not used to train AI models
9. Intellectual Property
Our Content
All content, software, code, design, text, images, logos, and other materials provided through EDmazing Learning's Services (collectively, "Our Content") are owned by EDmazing Learning or our licensors and are protected by United States copyright, trademark, and other intellectual property laws.
Our Content includes, but is not limited to:
- Assessment activity HTML files, questions, stories, passages, and images
- AI prompt templates and insight generation systems
- Website design, layout, and branding
- PDF report templates and formatting
- Tutoring curricula and supplementary materials
Your License to Use Our Content
Subject to these Terms and your valid license or purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use Our Content solely for your own educational purposes. This means:
- ✅ You may use purchased activities with your own students
- ✅ You may print or share PDF reports with parents and school administrators
- ❌ You may not copy, reproduce, modify, or create derivative works from Our Content
- ❌ You may not distribute, sell, sublicense, or share Our Content with individuals or organizations outside your license
- ❌ You may not reverse engineer, decompile, or extract source code from our activities
- ❌ You may not remove or alter any copyright notices, watermarks, or attribution
Student-Created Content
Responses, written answers, and other content created by students during assessment activities remain the property of the student and their school. EDmazing Learning claims no ownership of student-created content.
Feedback
If you provide us with suggestions, ideas, or feedback about our Services, you grant us the right to use that feedback without restriction or compensation. You are not obligated to provide feedback.
10. Acceptable Use Policy
When using our Services, you agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to our systems, servers, or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Upload or transmit viruses, malware, or other harmful code
- Use the Services to harass, bully, threaten, or harm any person
- Scrape, crawl, or use automated tools to extract content from our website or activities
- Impersonate another person or entity
- Share your teacher account credentials with others
- Redistribute, resell, or publicly post our assessment activities or their content
- Use our Services or content to create competing products
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and access to our Services.
11. Voice Recordings & Testimonials
EDmazing Learning may capture audio-only voice recordings of students for use in marketing materials. By providing written consent (as a parent or guardian), you agree to the following:
- Only the student's voice will be recorded — no photographs, video, full names, or identifying information will be published
- Recordings will be used solely for EDmazing Learning's marketing and promotional purposes (website, social media, presentations)
- Consent is voluntary and does not affect access to any EDmazing Learning service
- Consent may be withdrawn at any time by contacting alisha@edmazinglearning.com
- Upon withdrawal of consent, we will remove the recording from all marketing materials within a reasonable timeframe
- By providing consent, you grant EDmazing Learning a non-exclusive, royalty-free license to use the voice recording for promotional purposes until consent is withdrawn
12. Third-Party Services & Links
Our Services may include links to or integration with third-party platforms, including:
- Zoom — for tutoring sessions (Zoom Terms)
- Google Drive — for report storage (Google Terms)
- Canva and other learning tools — used during tutoring via shared links
- Google Fonts — for typography in activities
EDmazing Learning does not control these third-party services and is not responsible for their content, privacy practices, or terms of service. Your use of third-party services is governed by their respective terms and policies.
We do not endorse and are not liable for any third-party products, services, or content.
13. Privacy & Student Data
Your privacy is important to us. Our data practices are described in detail in our:
- Privacy Policy — covers all users (teachers, parents, visitors, tutoring students)
- Student Privacy page — detailed breakdown of how student data is handled in assessment activities
Key commitments incorporated into these Terms:
- We do not sell, rent, or share personal data with third parties for marketing purposes
- Student assessment data never enters our database and is not retained
- We comply with FERPA, COPPA, and Texas HB 18
- We are prepared to execute SDPC National Data Privacy Agreements with school districts
- Student data is not used to train AI models
14. Purchases & Licensing
How Purchases Work
All purchases of EDmazing Learning products and services are handled through purchase orders and billing processes outside of our website. No payment information is collected, stored, or processed through edmazinglearning.com.
License Scope
- Purchased activities are licensed, not sold. You receive a license to use the activities in accordance with these Terms
- Licenses are granted to the individual teacher, school, or district specified in the purchase order
- Licenses are non-transferable unless expressly agreed to in writing
- Bulk or district-wide licenses may be available — contact us for details
Refunds
Because our products are digital and delivered immediately, refund requests are handled on a case-by-case basis. Please contact us at alisha@edmazinglearning.com if you have concerns about a purchase.
15. Disclaimers
Without limiting the foregoing, EDmazing Learning does not warrant that:
- The Services will be uninterrupted, error-free, or free of viruses or other harmful components
- AI-generated insights will be accurate, complete, or appropriate for every student
- Tutoring services will result in specific academic outcomes, grades, or test scores
- Third-party services (Zoom, Google Drive, Canva) will function without interruption
- Assessment activities will be compatible with every browser, device, or network configuration
Educational Content Disclaimer
Our assessment activities and tutoring services are supplementary educational tools. They are not a substitute for professional educational evaluation, special education services, or individualized education plans (IEPs). Teachers and parents should use our Services as one component of a comprehensive educational approach.
16. Limitation of Liability
To the maximum extent permitted by applicable law:
- EDmazing Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services
- This includes, but is not limited to, damages for loss of data, loss of profits, business interruption, or any educational outcomes
- EDmazing Learning's total aggregate liability for any claims arising from or related to the Services shall not exceed the total amount you have paid to EDmazing Learning in the twelve (12) months preceding the event giving rise to the claim
- These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise)
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless EDmazing Learning, its owner, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Services in violation of these Terms
- Your violation of any applicable law or regulation
- Any content you submit, post, or transmit through the Services
- Your breach of any representation or warranty in these Terms
- Unauthorized sharing or redistribution of licensed content
18. Termination
By You
You may stop using the Services and request account deletion at any time by contacting us at alisha@edmazinglearning.com.
By Us
We may suspend or terminate your account and access to the Services at any time, with or without notice, if:
- You violate these Terms or the Acceptable Use Policy
- You engage in conduct that is harmful to other users, us, or third parties
- We are required to do so by law
- We discontinue or materially modify the Services
Effect of Termination
- Your license to use Our Content terminates immediately
- You must cease all use of our assessment activities and materials
- Student PDF reports already saved to your Google Drive remain yours — we do not have access to delete them
- Your Google Drive OAuth token will be invalidated on our end
- Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will remain in effect
19. Modifications to These Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- For material changes, we will notify registered users via email or a prominent notice on our website
- We will provide at least 30 days' notice before material changes take effect
- Your continued use of the Services after the effective date of any changes constitutes acceptance of the updated Terms
20. Governing Law & Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising from or relating to these Terms or the Services shall be resolved as follows:
- Informal Resolution: We encourage you to contact us first at alisha@edmazinglearning.com to attempt to resolve any dispute informally. We will make good-faith efforts to resolve your concern within 30 days.
- Mediation: If informal resolution is unsuccessful, the parties agree to attempt mediation before pursuing formal legal action.
- Jurisdiction: Any legal proceedings shall be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.
21. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
22. Entire Agreement
These Terms, together with our Privacy Policy and Student Privacy page, constitute the entire agreement between you and EDmazing Learning regarding the use of the Services. These Terms supersede any prior agreements, communications, or understandings, whether oral or written, regarding the subject matter herein.
In the event of a conflict between these Terms and a separately executed agreement (such as a district purchase order or SDPC National Data Privacy Agreement), the separately executed agreement shall take precedence with respect to the specific terms addressed therein.
